What are Trademarks and Service Marks?

Trademarks and service marks are words, acronyms, logos, slogans, taglines, or symbols that identify and distinguish a company as the source of its service or products. The owner of a valid trademark may prevent others from using its mark for particular services or goods, and may recover monetary damages caused by another's infringement. Trademarks and service marks can be classified in two categories:

Registered Marks

Trademarks indicated by the ® symbol have undergone the appropriate legal process and are registered with the U.S. Trademark Office.

Common Law

These are unregistered  trademarks or pending applications, indicated by the ™ symbol. They have not been formally registered, but may still be valid and enforceable, although registration provides additional legal rights.

FAHQ® Trademark Usage Policy

FAHQ LLC has invested significant time and resources to protect its trademark. Trademarks are important for establishing and protecting corporate brand identity but they are fragile rights that can be lost through misuse. The following Trademark Usage and Guidelines ("Policy") set forth the authorized legal policies for using or referring to FAHQ LLC trademarks, service marks, logos and slogans. This Policy does not otherwise grant the legal right to use the FAHQ trademark. The guidelines outlined below provide specific tools needed to apply the FAHQ mark consistently under this Policy.

  • Hyperlink to the FAHQ Website: When using the FAHQ trademark, include a hyperlink to the FAHQ website.
  • Maintain the Integrity of the FAHQ Trademark: The use of the FAHQ trademark must not disparage FAHQ, its mark, or products.
  • Apply the Trademark Correctly: Always use the registered trademark symbol "®" when referring to the FAHQ registered mark (e.g., FAHQ®).
  • Keep the FAHQ Trademark Separate and Distinct: The FAHQ trademark must be used separately from any other organization's logos, trademarks or service marks, and may not be used as part of the name for any other organization or its products or services. The FAHQ trademark must be used as an adjective followed by a common noun, verb or other phrase (e.g., "FAHQ® apparel" or "FAHQ® hoodies and t-shirts").
